Forged Studios / Legal
Subscription Terms
Effective Date: September 24, 2026
These Subscription Terms (“Terms”) govern subscriptions to websites, software, booking systems, business tools, hosting, support, and related services provided by Forged Studios (“Forged,” “we,” “us,” or “our”).
By purchasing, activating, or continuing to use a Forged subscription, you agree to these Terms.
These Terms are intended primarily for business customers. If any mandatory consumer protection law applies to your purchase, those legal rights continue to apply and take priority over any conflicting provision in these Terms.
1. Your Subscription
Your subscription includes the products, features, services, and usage limits described on the applicable Forged product page, checkout page, proposal, or order confirmation.
Depending on your plan, your subscription may include services such as:
- a business website;
- online booking or scheduling;
- payment integrations;
- customer management tools;
- staff or team management;
- reporting and administrative tools;
- hosting and technical maintenance;
- software updates;
- reasonable support; and
- other features specifically listed as part of your selected plan.
Features vary by product and plan.
If your order confirmation, proposal, or other written agreement with Forged includes terms that differ from these Subscription Terms, the more specific written terms will apply to that subscription.
2. Initial Commitment
Unless otherwise stated when you subscribe, Forged subscriptions have a minimum initial commitment of six (6) months.
The six-month commitment begins on your Subscription Start Date, described in Section 5. Submitting an order does not start it.
Subscriptions are billed monthly during the commitment period.
You may request cancellation at any time. However, if you cancel during the initial commitment period, your subscription will normally remain active and monthly payments will continue until the end of the six-month commitment period unless Forged agrees otherwise in writing.
There is no additional cancellation fee simply for cancelling at the end of your commitment.
3. Renewal After the Initial Term
After the initial commitment period, your subscription will automatically continue on a month-to-month basis unless your plan states otherwise.
Once your minimum commitment has been completed, you may cancel before your next billing date to prevent the following month's subscription charge.
Cancellation does not retroactively refund a billing period that has already started.
4. Billing and Payment
Forged uses Square as its payment processor for Forged subscriptions. Subscription fees are charged using the payment method you provide through Square when you make your first payment.
Unless otherwise stated:
- subscription fees are billed in advance;
- billing occurs monthly;
- prices are shown in Canadian dollars;
- applicable taxes are added at checkout or invoicing; and
- your billing date will be the date stated at checkout. For Forged Basic, your first payment is prorated for the remainder of the current billing period, and recurring monthly payments are then billed on the 1st of each month.
For Forged Basic, the current billing period is the calendar month in which your Subscription Start Date falls, so your first payment covers your Subscription Start Date to the end of that month. If your Subscription Start Date is the 1st of a month, your first payment is a full month.
By providing a payment method, you authorize Forged and its payment processor, Square, to charge applicable subscription fees, taxes, approved add-ons, and other amounts you have authorized.
You are responsible for keeping your billing and payment information current.
5. Subscription Start Date
Your Subscription Start Date is the date your first payment is successfully completed through Square.
Billing, your minimum commitment, and Forged's work on your service all begin on your Subscription Start Date.
Submitting an order or setup request on our website does not start your subscription, your billing, your minimum commitment or our work, and does not charge you. After we receive your order, we send you a secure Square payment link. Until your first payment is completed, you are not yet an active subscriber.
The Subscription Start Date is not necessarily the date your website or system becomes publicly available.
Once your first payment is completed, your subscription and your minimum commitment continue to run even if setup is waiting on information from you. For example, if Forged is waiting for your logo, photographs, colours, service information, pricing, domain details, staff information, business copy, account access, approvals, or other materials required to complete setup, the subscription continues to be billed and your Subscription Start Date does not change.
This helps us reserve development, infrastructure, hosting, and support resources for your account.
6. Setup and Onboarding
Some Forged subscriptions include standard setup or implementation.
Unless expressly included in your plan, standard setup does not include unlimited custom development, extensive data migration, custom integrations, professional photography, copywriting, branding work, advertising services, or other work outside the normal product configuration.
If your request is materially outside the scope of your subscription, we will tell you before performing additional billable work whenever reasonably practical.
Additional work may be quoted separately.
7. Customer Responsibilities
To provide your service, we may need information or cooperation from you.
You are responsible for providing accurate and reasonably timely:
- business information;
- pricing;
- service descriptions;
- schedules and availability;
- policies;
- logos and brand assets;
- photographs or other media;
- domain or account access where required;
- payment processor information;
- approvals; and
- other materials necessary to configure your service.
You are responsible for reviewing information displayed through your website or system and notifying us if something is inaccurate.
You are also responsible for ensuring that the products, services, claims, policies, pricing, content, and business practices you ask us to publish are lawful and accurate.
8. Third-Party Services
Forged products may connect with third-party providers such as:
- Square;
- Stripe;
- domain registrars;
- email providers;
- SMS providers;
- mapping services;
- analytics providers;
- social media platforms;
- accounting software; or
- other external services.
Those services may be governed by their own terms and privacy policies.
Unless specifically stated as included in your Forged subscription, third-party charges are your responsibility. Examples may include payment processing fees, domain registration fees, SMS usage, premium email services, advertising spend, or other usage-based charges.
Forged is not responsible for outages, pricing changes, account restrictions, policy changes, or service interruptions caused by a third-party provider that we do not control.
9. Price Changes
Your subscription price will not normally increase during your initial commitment period unless:
- you change plans;
- you purchase additional services;
- your usage exceeds the limits of your plan;
- you approve additional work; or
- a change is required because of taxes or third-party costs specifically passed through to you.
After the initial commitment period, Forged may change subscription pricing by providing reasonable advance notice.
If you do not agree with a future price change, you may cancel your month-to-month subscription before the new price takes effect.
10. Failed Payments
If a payment fails, we may attempt to process the payment again and may contact you to update your payment information.
If an account remains unpaid, Forged may temporarily suspend some or all services until the outstanding balance is resolved.
We will make reasonable efforts to provide notice before suspending an active customer-facing website or system for non-payment.
Suspension does not automatically cancel outstanding amounts owed under an active minimum commitment.
11. Refunds
Subscription payments are generally non-refundable once a billing period has started.
We do not normally issue prorated refunds for:
- unused portions of a month;
- periods where you chose not to use the service;
- delays caused by missing customer information or approvals; or
- cancellation during an active billing period.
This does not limit any refund or cancellation right that cannot legally be excluded.
If Forged makes a billing error, contact us and we will review and correct it where appropriate.
12. Your Business Content
You retain ownership of the original content you provide to Forged, including your:
- logo;
- photographs;
- written content;
- trademarks;
- product information;
- customer information; and
- other business materials.
You give Forged permission to host, reproduce, format, process, and display that content as reasonably necessary to provide your services.
You represent that you have the necessary rights to any content you ask us to use.
13. Forged Software, Designs and Technology
Unless you have purchased them under a separate written agreement, Forged retains ownership of its underlying:
- software;
- source code;
- platform;
- frameworks;
- reusable components;
- templates;
- system architecture;
- administrative tools;
- workflows;
- designs;
- integrations; and
- other proprietary technology.
Your subscription gives you the right to use the applicable Forged service for your business while your subscription remains active.
A monthly subscription does not transfer ownership of Forged's underlying software or source code to you.
14. Custom Buyout or Ownership Arrangements
Some customers may wish to purchase a custom system, source-code transfer, perpetual licence, or other ownership arrangement.
These arrangements are not included in a standard subscription unless expressly stated.
Any buyout, source-code transfer, custom licence, or ownership arrangement must be agreed to separately in writing and may require an additional fee.
15. Domains
Domain ownership and management will depend on the arrangement selected during setup.
Where practical, Forged prefers domains intended specifically for your business to be registered to, or transferable to, your business.
If Forged manages a domain on your behalf, applicable domain registration or renewal charges may be included in your plan or charged separately as disclosed to you.
Outstanding amounts must be resolved before Forged is required to perform administrative work related to a requested transfer, except where prohibited by law or applicable domain-provider rules.
16. Customer and Business Data
Your business remains responsible for the customer and operational data associated with your business.
Forged may process and store information as necessary to provide, secure, maintain, and improve the subscribed services.
Our handling of personal information is also governed by our Privacy Policy.
Upon cancellation, we may provide reasonable options to export customer or business data where the applicable product supports export.
After your subscription ends, we keep your service's operational data for 90 days, so that you can request an export, reverse an accidental cancellation, or receive final support. After those 90 days we delete it or irreversibly anonymize it, except for information we must keep for legal, tax, accounting or dispute reasons, as described in our Privacy Policy.
You should request any required data export within 90 days after your subscription ends.
17. Support and Maintenance
Active subscriptions include the level of support described for the applicable plan.
Forged may perform updates, maintenance, security changes, infrastructure improvements, and other work necessary to operate the service.
We aim to keep Forged services reliable, but no online service can guarantee uninterrupted or error-free operation at all times.
Temporary interruptions may occur because of maintenance, software issues, internet infrastructure, third-party providers, security incidents, or circumstances outside our reasonable control.
18. Reasonable Use
You may not use a Forged service to:
- conduct unlawful activities;
- distribute malware or harmful software;
- intentionally interfere with the service;
- attempt to gain unauthorized access to systems or accounts;
- abuse platform infrastructure;
- infringe intellectual property rights;
- send unlawful spam or deceptive communications; or
- operate in a way that creates unreasonable security, legal, or technical risk.
We may restrict or suspend access where reasonably necessary to protect customers, Forged, third parties, or the security and integrity of the service.
19. Cancellation by Forged
Forged may terminate or refuse to renew a subscription for reasons including:
- continued non-payment;
- fraud or suspected fraudulent activity;
- illegal use;
- serious abuse of the service;
- material violation of these Terms;
- security threats;
- repeated misuse of Forged systems; or
- circumstances where continuing to provide the service would create unreasonable legal or operational risk.
Where reasonably possible, we will provide notice and an opportunity to correct the issue before termination.
If Forged terminates a subscription without cause, we will not require payment for future subscription periods that occur after the effective termination date.
20. What Happens When Your Subscription Ends
When your subscription ends:
- access to subscription-only Forged software may stop;
- hosted services may be disabled;
- ongoing maintenance and support will stop;
- third-party services managed through Forged may need to be transferred or reconfigured;
- your licence to use Forged's proprietary platform ends; and
- any outstanding amounts already owed remain payable.
Where applicable, we will reasonably cooperate with requests to transfer customer-owned domains, content, or exportable business data.
Cancellation of a subscription does not transfer ownership of Forged software, source code, templates, or proprietary systems.
21. No Guarantee of Business Results
Forged provides technology and digital services.
We do not guarantee a particular level of:
- revenue;
- bookings;
- leads;
- website traffic;
- search-engine ranking;
- customer growth;
- profitability; or
- other business results.
Your results depend on many factors outside Forged's control, including your market, pricing, reputation, advertising, competition, operations, and customer demand.
22. Limitation of Liability
To the maximum extent permitted by law, Forged will not be responsible for indirect, incidental, special, consequential, or speculative losses arising from the use or inability to use the service, including lost profits, lost opportunities, or losses caused by third-party services.
To the maximum extent permitted by law, Forged's total liability relating to a subscription will not exceed the subscription fees paid by the affected customer to Forged during the six months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability or legal rights that cannot lawfully be excluded or limited.
23. Changes to These Terms
We may update these Subscription Terms as Forged products and services evolve.
Material changes affecting an active paid subscription will be communicated through reasonable means, such as email, an account notice, or a notice on our website.
Changes will not retroactively alter fees or commitments that have already become due.
24. Governing Law
These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.
Subject to any rights that cannot legally be restricted, disputes relating to these Terms or a Forged subscription will be handled in Alberta, Canada.
